These Terms of Service (“Terms”) govern your access to and use of Hakeemi PPE, including our website at hakeemippe.com, and your purchase of products from us.

Throughout these Terms, “Hakeemi PPE,” “we,” “us,” and “our” refer to Extensive Commerce LLC, a Texas limited liability company operating the Hakeemi PPE online store. “You” and “your” refer to any visitor, customer, purchaser, or other user of our website.

By accessing our website, placing an order, or otherwise using our services, you agree to these Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy.

If you do not agree with these Terms, please do not use our website or purchase products from us.

1. Online Store Terms

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order through our website.

You agree to provide current, complete, and accurate billing, shipping, contact, and payment information when placing an order.

You may not use our products, website, or services for any unlawful, fraudulent, abusive, or unauthorized purpose.

We reserve the right to refuse service, restrict purchases, cancel orders, or terminate access to our website where we reasonably believe there has been fraud, abuse, violation of these Terms, unauthorized resale, payment misuse, or unlawful activity.

2. Products and Product Information

We make reasonable efforts to display product descriptions, specifications, photographs, colors, packaging, dimensions, quantities, certifications, and other information accurately.

However, manufacturers may modify packaging, labeling, appearance, or non-material product characteristics without notice. Display colors may also vary depending on your device.

Product photographs are provided for illustration and identification purposes and may not perfectly represent the appearance of the product received.

Any regulatory, safety, certification, performance, or standards-related claim—including references to NIOSH approval, ASTM standards, FDA status, exam-grade classification, filtration efficiency, or similar standards—applies only to products for which that claim is expressly stated on the applicable product page or manufacturer documentation.

You should not assume that a certification or specification applicable to one Hakeemi PPE product applies to another product.

We reserve the right to modify or discontinue products without notice.

3. Personal Protective Equipment Disclaimer

Hakeemi PPE sells personal protective equipment and related products.

PPE is designed to reduce certain risks when selected, fitted, worn, stored, and used correctly, but no personal protective equipment can eliminate all risk of exposure, infection, illness, contamination, injury, or death.

Purchasing or using a respirator, mask, glove, or other PPE product does not guarantee protection against any particular disease, contaminant, chemical, biological agent, airborne particle, occupational hazard, or other risk.

Customers are responsible for:

  • Selecting products suitable for their intended use
  • Reviewing all manufacturer instructions and warnings
  • Ensuring proper sizing and fit
  • Following applicable workplace and safety requirements
  • Replacing products when necessary
  • Using products only for their intended purpose

Where respiratory protection is required in an occupational setting, customers and employers remain responsible for complying with applicable OSHA respiratory protection, fit-testing, training, medical evaluation, and workplace safety requirements.

Nothing on our website constitutes medical, occupational safety, or professional healthcare advice.

If you are unsure whether a product is suitable for a particular medical condition, occupational hazard, chemical exposure, or specialized application, consult an appropriately qualified professional.

4. Prices

All prices are displayed in U.S. dollars (USD) unless otherwise stated.

We reserve the right to change prices at any time without notice.

A price displayed on the website does not obligate us to fulfill an order where the price resulted from an obvious typographical, technical, system, feed, or pricing error.

If we discover an incorrect price after an order has been submitted, we may cancel the affected order or contact you to allow you to purchase the product at the correct price.

If payment has already been collected for an order that we cancel, the appropriate amount will be refunded to the original payment method.

5. Orders and Acceptance

Submitting an order does not constitute final acceptance of that order.

We reserve the right, before shipment, to accept, refuse, limit, or cancel an order for legitimate business reasons, including:

  • Product availability
  • Pricing or listing errors
  • Suspected fraud
  • Payment authorization problems
  • Unusual order quantities
  • Incorrect customer information
  • Suspected abuse of promotions
  • Suspected unauthorized or unlawful transactions

If we cancel an order after receiving payment, we will refund the applicable amount.

We may limit quantities available to any person, household, customer account, shipping address, or order.

We may use fraud-prevention systems and may request additional verification before fulfilling an order.

An order may be delayed or cancelled if payment cannot be authorized or if we reasonably suspect fraudulent activity.

Customers agree not to knowingly initiate false, fraudulent, or abusive payment disputes or chargebacks.

We reserve the right to provide transaction records, order confirmations, tracking information, communications, and other relevant evidence to payment processors, banks, or financial institutions when responding to disputes.

Nothing in this section limits legitimate rights provided to consumers by law or their payment provider.

7. Shipping and Delivery

Hakeemi PPE sells and ships products within the United States, unless otherwise expressly stated.

Orders may be processed and fulfilled by third-party warehouses, fulfillment providers, and shipping carriers on our behalf.

Shipping methods, estimated delivery times, and other shipping conditions are described in our Shipping Policy, which forms part of these Terms.

Delivery estimates are based on information reasonably available to us and our fulfillment partners at the time an order is placed.

We are not responsible for delays caused by circumstances outside our reasonable control, including:

  • Severe weather
  • Natural disasters
  • Carrier delays
  • Transportation interruptions
  • Government actions
  • Emergencies
  • Incorrect or incomplete addresses
  • Supply-chain disruptions
  • Other force majeure events

Customers are responsible for providing a complete and accurate shipping address.

Additional costs resulting from an incorrect address, refused shipment, failed delivery, or failure to collect a package may be the customer's responsibility to the extent permitted by law.

8. Delivered, Lost, or Stolen Packages

Customers should promptly contact us if an order does not arrive as expected.

If tracking information shows that a package was delivered to the shipping address provided by the customer, we may require the customer to:

  • Check the delivery location
  • Check with household members or building personnel
  • Contact the carrier
  • Allow time for carrier investigation
  • Provide information necessary to investigate the claim

We will reasonably assist with carrier investigations where appropriate.

We cannot guarantee replacement or reimbursement for packages stolen or lost after confirmed delivery, except where required by applicable law or where we otherwise agree to provide a replacement or refund.

9. Returns, Exchanges, and Refunds

All returns, exchanges, and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms.

Unless otherwise expressly stated by Hakeemi PPE or required by applicable law:

The customer is responsible for all shipping costs associated with returns, exchanges, replacements requested by the customer, and sending merchandise back to Hakeemi PPE in all return or exchange scenarios.

Original shipping charges, expedited shipping charges, and return shipping expenses are generally non-refundable except where required by law.

Because certain PPE and healthcare-related products are hygienic or protective products, opened, worn, used, altered, contaminated, damaged, or otherwise non-resalable merchandise may not be eligible for return or exchange, subject to applicable law and our Return & Refund Policy.

Products must satisfy all applicable return conditions before a refund is approved.

We reserve the right to reject returns that do not comply with our published return requirements.

Approved refunds will ordinarily be returned to the original payment method.

10. Damaged, Defective, or Incorrect Products

Customers should inspect their orders promptly after delivery.

If you believe you received an incorrect, damaged, or defective product, contact us at info@hakeemippe.com as soon as reasonably possible and provide:

  • Order number
  • Description of the issue
  • Photographs where appropriate
  • Any other reasonably requested information

Do not dispose of the product or packaging while a claim is being investigated unless instructed by us.

We reserve the right to determine the appropriate remedy after reviewing the circumstances, subject to applicable consumer law.

11. Promotions, Discounts, and Coupon Codes

Promotional offers may be subject to additional conditions.

Unless otherwise stated:

  • Promotional codes cannot be exchanged for cash
  • Discounts cannot be applied retroactively
  • Promotions may not be combined
  • Promotions may have quantity or customer limits
  • Promotional offers may be modified or withdrawn before an order is placed

We may cancel orders involving fraudulent, automated, unauthorized, duplicated, or abusive use of promotions.

12. Product Use and Customer Responsibility

You are responsible for determining whether a product is suitable for your intended use.

You agree to follow all manufacturer instructions, safety warnings, storage requirements, expiration information, fit requirements, and usage directions supplied with the product.

To the extent permitted by law, Hakeemi PPE is not responsible for damage, injury, illness, loss, or reduced product performance resulting from:

  • Improper storage
  • Use beyond expiration
  • Failure to follow manufacturer instructions
  • Use for an application for which the product was not designed

Information appearing on Hakeemi PPE's website, including articles, FAQs, product descriptions, educational material, and marketing content, is provided for general informational purposes only.

It is not medical advice, diagnosis, treatment advice, occupational safety advice, or a substitute for consultation with an appropriately qualified professional.

Never delay or disregard professional medical advice because of information found on our website.

14. Third-Party Manufacturers and Services

Some products sold by Hakeemi PPE are manufactured by third parties.

Manufacturer names, trademarks, certifications, product specifications, instructions, and warranties remain the responsibility of the applicable manufacturer where relevant.

Our website may also contain links to third-party websites or services.

Hakeemi PPE does not control third-party websites and is not responsible for their content, policies, security, availability, or practices.

Our use of third-party fulfillment providers, carriers, payment processors, technology providers, or other service providers does not create a direct contractual relationship between those providers and the customer unless separately stated.

Unless otherwise stated, the content of hakeemippe.com, including branding, logos, website design, text, graphics, photographs, videos, product arrangements, and original written material, is owned by or licensed to Hakeemi PPE and is protected by applicable intellectual property laws.

You may not reproduce, copy, republish, distribute, commercially exploit, scrape, modify, or create derivative works from our content without permission, except where permitted by law.

Third-party trademarks and product names remain the property of their respective owners.

16. Reviews and User-Submitted Content

If you submit a review, photograph, testimonial, comment, or other content to Hakeemi PPE, you represent that:

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

EXCEPT FOR WARRANTIES EXPRESSLY PROVIDED BY US, A MANUFACTURER, OR REQUIRED BY LAW, HAKEEMI PPE AND EXTENSIVE COMMERCE LLC DISCLAIM WARRANTIES, REPRESENTATIONS, OR CONDITIONS THAT MAY OTHERWISE ARISE BY LAW, COURSE OF DEALING, USAGE, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES TO THE EXTENT THEY MAY LEGALLY BE DISCLAIMED.

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAKEEMI PPE, EXTENSIVE COMMERCE LLC, AND THEIR OWNERS, MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR WEBSITE, SERVICES, OR PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING FROM A PARTICULAR PURCHASE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO HAKEEMI PPE FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot legally be excluded or limited under applicable law.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Extensive Commerce LLC, Hakeemi PPE, and their owners, members, affiliates, employees, contractors, and service providers from third-party claims, losses, liabilities, and reasonable expenses arising from your:

  • Infringement of another person's rights
  • Misuse or unauthorized modification of products

20. Force Majeure

Hakeemi PPE and Extensive Commerce LLC will not be responsible for delays or failures caused by events beyond our reasonable control, including:

  • Civil disturbances
  • Government actions
  • Labor disputes
  • Transportation interruptions
  • Carrier failures

This provision does not remove any cancellation, refund, or other rights that cannot legally be waived.

26. Governing Law

These Terms and any dispute arising from or relating to them, our website, services, or products will be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable federal law or mandatory consumer protection law provides otherwise.

To the extent permitted by law and unless otherwise agreed, disputes that are not subject to another legally required forum shall be brought in a court of competent jurisdiction located in Texas.

Nothing in these Terms limits rights that a consumer may have under applicable federal or state law.
